Citizen liberty must be understood as that recognized by the laws in force in a certain time and space, therefore both freedom and the exercise of power are subject to the rule of law, freedom being the immunity that citizens have before the law. abuse of the power of the ruler. Therefore, the Constitution, as a normative body, should act as a brake on abuse of power and protection of freedoms. With the installation of the National Constituent Assembly in Venezuela in 2017 at the initiative of President Nicolás Maduro Moros, supported by the decisions issued by the Constitutional Chamber of the Supreme Court of Justice, without a referendum prior to the citizenship, the Constitution has been transfigured in force, which generates as a consequence that the constitution project that the National Constituent Assembly draws up in such form, becomes a Constitution granted from the exercise of power and not in a democratic Constitution supported by the participation and approval of the people.
