Fundamental concepts for a methodology of law: An Introduction

Abstract

Law is a social system, and as such, it performs differentiated operations on the one hand, and joint operations with other social systems on the other. A legal methodology must begin with this idea, as it allows for the analysis of the system's inherent elements and how it interacts with others. This requires an analytical understanding of the system's components that allow for its structural description, keeping in mind that much of legal analysis takes place in the realm of language. Here, a series of concepts and examples are presented to facilitate this process of legal analysis. These include social context and legal plasticity or coverage—that is, how the law responds to social problems; normative density, indexicality, and interdefinability—tools for analyzing the semantic context; the process of categorization, or the mechanism for breaking down normative statements; and, finally, stabilization—the mechanism through which the law resolves a case and how this affects the legal system and its impact on other social systems. These components for legal analysis are crucial for a clearer and more precise understanding of the complexity of legal reality and its relationships with other social experiences.
